Terms of Service — Open Bazaar

1. Acceptance of Terms

By accessing or using Open Bazaar (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform. We may update these Terms at any time; continued use of the Platform constitutes acceptance of the updated Terms.

2. Description of Service

Open Bazaar is a free online classifieds platform that allows users to post, search, and respond to advertisements for goods and services. Open Bazaar is not a party to any transaction between buyers and sellers; we do not process payments, take title to goods, or provide warranties for items listed on the Platform.

3. User Accounts

You must create an account to post advertisements. You agree to:

Provide accurate and complete information during registration.
Keep your login credentials secure and not share them with others.
Notify us immediately if you suspect unauthorised access to your account.
Be responsible for all activity that occurs under your account.

4. Prohibited Content & Conduct

You may not post or transmit content that:

Is illegal, fraudulent, deceptive, or misleading.
Infringes on intellectual property rights.
Contains personal information of third parties without consent.
Promotes violence, hatred, or discrimination.
Involves prohibited items (weapons, counterfeit goods, drugs, etc.).
Is sexually explicit or involves minors in any inappropriate context.
Is spam, unsolicited advertising, or automated bot activity.

5. Listing Rules

All listings must accurately describe the item or service for sale. Duplicate listings for the same item are not permitted. Prices must be stated clearly in Indian Rupees (₹). Open Bazaar reserves the right to remove any listing that violates these Terms or our Posting Policy without notice.

6. Disclaimers

Open Bazaar provides the Platform on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the Platform or any listings on it. We are not responsible for the conduct of any user, the quality or legality of any item listed, or the outcome of any transaction.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Open Bazaar and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of profit, data, or goodwill.

8. Intellectual Property

The Open Bazaar name, logo, and all content on the Platform (excluding user-generated content) are the property of Open Bazaar and may not be used without prior written permission. By posting content on the Platform, you grant Open Bazaar a non-exclusive, royalty-free, worldwide licence to display and distribute that content in connection with the operation of the Platform.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time from your Profile settings.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
